Well that depends on Hillary and French pressure apparently:

"The Arrest of Roman Polanski: France and Poland Appeal to Hillary Clinton to Intervene"

"The French and Polish governments stepped into the case Monday, urging Switzerland to release the 76-year-old Polanski, who was arrested at the Zurich"

BTW, don't ask the Sovereign Society as certain of their leading members might find a certain kinship with Polanski, or the perpetual travelers who write books on the best countries for such activities.
