    Hundreds of millions of dollars at stake in claims from ‘quack’ doctor’s work

    Four Bermuda insurers have been named as defendants in a lawsuit brought on behalf of 70 patients of an osteopathic surgeon who has been accused of killing or maiming dozens of patients in the United States.The difference between success and failure may amount to hundreds of millions of dollars for XL Insurance Company Ltd., ACE Insurance Company Ltd., Starr Excess Liability Insurance International Ltd., Allied World Assurance Company Ltd. and two non-Bermuda co-defendants: Teays Valley Health Services, LLC, d.b.a.     XL and AWAC settle Hurricane Katrina-related lawsuit in Louisiana

    Two Bermuda insurers have settled a civil lawsuit in which a waste management insured accused them of failure to pay claims stemming from Hurricane Katrina. A stipulation of dismissal was entered on February 5, 2007 in an action that was filed by Waste Management Inc., a Delaware corporation based in Houston, Texas; Waste Management Louisiana LLC, a Delaware corporation based in Baton Rouge, Louisiana; and Waste Management of Mississippi Inc., a Mississippi corporation based in Baton Rouge, Louisiana, against XL Insurance (Bermuda) Ltd., and Allied World Assurance Company Ltd. at the U. S. District Court for the Eastern District of Louisiana on August 25, 2006.

    XL & other Bermuda-related firms sued for $32.4 m in Texas

    XL Insurance (Bermuda) Ltd. and other companies with Bermuda connections are being sued for $32.4 million in the United States regarding the alleged non-payment of a business interruption claim. The complaint was filed at the District Court of Harris County, Texas, 113th Judicial District on December 5, 2005 and transferred to the U. S. District Court for the Southern District of Texas on April 7, 2006 following an application by XL.

    Bermuda companies sued by Marsh clients over bid-rigging scheme

    Eight Bermuda based companies are among the defendants in a recently civil lawsuit filed recently by clients of broker Marsh & McLennan who claim they were damaged in a bid rigging scam. One of the plaintiffs is also incorporated in Bermuda.

    AT&T sues XL Insurance over 9/11 coverage

    AT&T Corp. has filed a civil complaint against 15 insurers, including XL Insurance (Bermuda) Ltd., over allegedly unpaid property damage and business interruption claims concerning 9/11. The telecommunications giant, which is registered in New York but based in New Jersey,  is seeking an award of not less than $139 million in an action filed at New Jersey Superior Court on June 11, 2004.

    Bermuda firms sued for between $21 m and $75 m over coal-mine claim

    Bermuda-based firms are among seven insurers being sued for at least $21 million resulting from claims over alleged methane ignitions at a coal mine in West Virginia.The action was filed by PinnOak Resources LLC, of Canonsburg, Pennsylvania, and its parent, Pinnacle Mining Company LLC, at the Circuit Court of Wyoming County in West Virginia on February 6, 2004 and removed to the U. S. District Court for the Southern District of West Virginia on March 4, 2004.

    XL Insurance and Swiss Re settle differences

    XL Capital announced on February 27 that its insurance subsidiary, XL Insurance (Bermuda) Ltd, and Swiss Re Financial Products Corp. had withdrawn their respective claims in the lawsuit filed in London in 2001 related to a contractual disagreement over the validity of a "reference entity" and the operation of certain other terms and conditions contained in a credit default swap between the two companies.

    Two Tennessee stock brokers accused of profiting from insider trading in shares of Mid Ocean Ltd. prior to the announcement of its acquisition by EXEL in March, 1998 have settled an SEC lawsuit. Cristan Kinnard Blackman and Charles Ray Roberts Jr., who both worked for broker Morgan Keegan & Co. at the time, agreed to disgorge profits of $317,409 that they made from the trades.

    Evidence of insider trading in Mid Ocean shares prior to take-over

    Investors apparently acting on inside knowledge made a killing in the derivatives market on the last day of trading before it was announced that EXEL was buying Mid Ocean, we can reveal. The volume of contracts traded in Mid Ocean call options on the American Stock Exchange increased from an average daily volume of 30 contracts to 950 contracts on Friday, March 13 - two days before the deal was signed and three days before it was announced.

    EXEL forms reinsurer

    Bermuda-based EXEL Ltd. has announced it intends to establish a wholly-owned subsidiary, XL Reinsurance Company Ltd., to provide specialty reinsurance coverage for captives, commercial insurance reinsurance companies, with a start-up capital of $250 million. It is expected to be operational by December 1, 1995.In addition, another EXEL subsidiary, XL Insurance Company Ltd., will increase the maximum limits offered to general liability clients to $150 million from $100 million. Individual directors and officers liability insurance limits for "Side A" coverage only are being raised to $50 million from $25 million.
