Ten Commandments for Cross-Border Insolvency Office-Holders

    This session will examine the dos and don'ts for insolvency office-holders.Given the number of large scale, multi-creditor and trans-national insolvencies in recent years, it's not surprising that insolvency office-holders have increasingly found themselves under the lens, whether that be of the supervising court or indeed of the creditor committee.A number of recent court decisions in the common law world have highlighted the duties required and standards expected of insolvency office-holders. These decisions make clear the need for heightened scrutiny and due diligence in the exercise of those office-holders' functions and how the courts will approach applications to fix remuneration.These decisions and other developments in this area will be examined in detail during this session.Speakers
